Another appellate opinion post! In this opinion, my future employer, uh, that is, I mean the Third Circuit recently held that Federal Rule of Evidence 407, which makes subsequent remedial measures inadmissible to prove causation, does not apply to measures taken by a non-party, despite the rule's passive construction of "[w]hen . . . measures are taken."
